Yes, but subject to strict land ownership restrictions. While foreigners can directly own buildings and individual condominium units (holding a Condominium Certificate of Title, or CCT), they are prohibited from directly owning the land itself. However, indirect land ownership is possible by establishing a Philippine corporation, provided it maintains at least 60% Filipino ownership.

Before handing over any funds, ensure the property is legitimate by verifying three crucial documents: the TCT or CCT via the Registry of Deeds (to confirm ownership and check for liens), the Tax Declaration and receipts from the local Assessor and Treasurer (to ensure taxes are paid), and the DHSUD License to Sell (if buying a pre-selling condo or subdivision) or Authority to Sell (if buying non-condo non-subdivision property from a Broker/Agent).

Always factor in closing costs! On top of the purchase price, expect to pay an extra 2.5% to 5.0% in transactional fees. This covers the Documentary Stamp Tax (1.5%), Transfer Fee (0.5% to 0.75%), Registration Fee (0.25% to 1%), and Notary Fees (usually 1% to 2%).

While the buyer is ultimately responsible for ensuring the land title is successfully transferred to their name (as they hold the greatest interest in securing legal ownership), the actual process is a joint responsibility. The seller is legally obligated to sign the Deed of Absolute Sale, clear any outstanding real property taxes, and hand over the original Owner’s Duplicate Copy of the title. The buyer (often assisted by a real estate broker or title transfer specialist) must then pay the transfer-related taxes and registration fees to secure the Certificate Authorizing Registration (CAR) from the Bureau of Internal Revenue (BIR) and register the new title under their name at the Registry of Deeds.

While legally the seller is responsible for the Capital Gains Tax (CGT) and the buyer typically covers the Documentary Stamp Tax (DST) and transfer fees, in the Philippines, these are highly negotiable and can be structured differently in the contract. Sellers need to know their default obligations.

Pricing a real estate property is easy to mess up. Price it too low, and you leave money on the table; price it too high, and it sits on the market indefinitely.
